The Screen & Broadcast Licence (or EULA) allows for the font(s) to be shown on screen in a film, television programme, or advertisement that is broadcast to viewers via any medium, such as a cinema screen, cable television, physical media discs or online streaming platforms. As well as for titles and credits, this EULA permits the font(s) to be used for any graphic design work to create props for use within the film/programme/video/advertisement. Please note that this licence allows the font(s) to be used for a SINGLE TITLE only.
| PERMITTED | NOT PERMITTED |
|---|---|
| Use the fonts for any instance of text appearing on screen. | |
| Use the fonts to create props for use within the project. | |
| Use the fonts for a single title. If the title is a series of multiple episodes, this EULA covers every episode per series/season. | Use of the fonts in any follow-up, sequel, additional series or advertising campaign to the licensed title. |
By downloading and/or installing font software (“Font”) offered by Paulo Goode (“The Foundry”), you (“Licensee”) agree to be bound by the following terms and conditions of this End User Licensing Agreement (“EULA”):
1. Licence-specific Definition
“Single Title”: A single film, television programme, video, or advertisement released for public viewing via any medium (e.g., cinema, TV broadcast, Blu-ray disc) or on any platform (e.g., Netflix, Paramount+, YouTube). A series/season of programmes of multiple episodes intended for television/streaming broadcast is considered a Single Title. An advertising campaign for a single product/event/promotion that may contain multiple ads is also considered a Single Title. All follow-ups, sequels, additional series/seasons, additional ad campaigns would require additional licence purchases. See Section 3 “Usage” for clarification.
2. Right Granted
This Screen & Broadcast EULA applies to each individual Font offered by The Foundry whether a single font or multiple fonts were purchased from The Foundry website. The Licensee is prohibited from employing the Font for anything other than a Single Title.
Once full payment is received, The Foundry grants the Licensee a perpetual, worldwide, non-exclusive, and non-transferable licence to use the Font and any designs created with it appearing in the Single Title. This grant is subject to full compliance with all terms of this EULA. Specifically, this EULA allows for the appearance on screen of the Font in any situation (e.g., title sequences, end credits, props made for use, etc.) in the Single Title. The Licensee may designate authorised Users (up to a maximum of 12 individuals) of the Font to prepare typographic content for the Single Title. Similarly, use of the Font across multiple geographic locations (e.g., by remote teams) is allowed at the discretion of the Licensee. Installation and use of the Font on both a personal desktop computer and one other portable device is allowed per authorised User (graphic designer/production team member) involved with the licensed Single Title.
The Licensee may make one backup copy of the Font solely for archival purposes.
3. Usage
The Font may be used in a single advertising campaign that may contain multiple ads (e.g., with different styles, scripts, actors, duration) for a single product, event or promotion – this is classified as a Single Title.
Examples:
• A smartphone manufacturer releasing a new model and there are various ads on TV and in cinemas worldwide to promote its new features, later in the year another series of ads are released to promote the phone’s most popular capabilities. All ads in this campaign for a single product are covered by this Screen & Broadcast EULA. When the manufacturer launches their next model phone and again wishes to use the Font for brand consistency, then an additional Screen & Broadcast EULA is required.
• Similarly, a TV series/season that will have multiple episodes is also classified as a Single Title. For example, a broadcaster launches a show called Doctor What that runs for 12 episodes. The Font may be used according to the terms of this EULA within all 12 shows. When the show is re-commissioned for Season Two an additional Screen & Broadcast EULA will need to be purchased if the Font is to be used again.
• Another usage example would be when the Single Title movie Star Battles uses the Font for its title sequence and the movie’s sequel, Star Battles: Return of the Gumbys, needs to replicate the title sequence using the same Font, then an additional Screen & Broadcast EULA will need to be purchased from The Foundry.
Any instances of a broadcast that falls outside of the above use cases (e.g., ongoing or indefinite series, daily news/sports/entertainment shows, etc.) are not Single Titles and would require a custom licence from The Foundry.
4. Limitations of Use
Use of the Font, as described below, IS NOT PERMITTED. An alternative EULA or custom licence may be purchased from The Foundry to suit your requirements.
a) Products. Licensee may not use the Font to create physical products or printed materials related to the Single Title. Contact The Foundry directly to arrange a custom licence for this purpose.
b) Apps, Games & Software. Embedding the Font for use in any app/game/software for distribution that is related to the Single Title is prohibited. An alternative EULA (for App) should cover most requirements and is available through The Foundry website, however, in some cases a custom licence may still be required.
c) Websites. Uploading the Font to a website associated with the Single Title on the Internet to display “live” text is prohibited. The Webfont EULA is required for all such purposes where an internet-specific font format is provided (WOFF).
d) Digital Ads. Digital advertising for promoting the Single Title that uses the Font is prohibited. If your advertising requires the Font for advertising that appears on the Internet, Digital Billboards, or within Social Media Apps then you will require the Digital Ads EULA available via The Foundry website.
5. Provision to Third Parties
Licensee may temporarily provide the Font to a graphic designer, agent or independent contractor who is working on behalf of the Licensee, ONLY IF the designer, agent or independent contractor (1) agrees in writing to use the Font exclusively for Licensee’s work, according to the terms of this EULA, and (2) retains no copies of the Font upon completion of the work. Licensee may not otherwise distribute the Font to third parties or make the Font publicly accessible except by embedding or linking in accordance with this EULA.
6. Term
This EULA grants a perpetual licence for the rights set forth in Paragraph 2 unless and until the EULA terminates under Paragraph 11. The Foundry will not charge additional fees after purchase, annually or otherwise.
7. Other Usage
If the Licensee is a design consultancy, advertising agency, or purchasing this EULA on behalf of a client or other organisation, the ultimate end user (e.g., the client) must purchase their own separate Screen & Broadcast EULA if they require access to or use of the Font. This EULA covers use by the Licensee’s temporary staff, freelancers, or contractors only for the single licensed campaign and does not extend to their independent professional use.
EULAs for @font-face embedding, computer applications and games, installable interactive books, software, mobile applications and games, eBooks and ePubs, product creation websites, website template distribution, website templates, and other uses not allowed by this EULA are available at The Foundry website.
8. Image Creation
Licensee is permitted to use the Font to make JPEG, PNG, SVG and GIF pixel-based images for the Single Title provided that the images are made by the Licensee or an authorised User.
9. Modifications
Licensee may import and alter the bezier outlines of the Font in a drawing program for purposes of logo/title creation, artwork for props, etc. Licensee may not modify the Font or create derivative works based on the Font without prior written consent from The Foundry.
10. Copyright
The Font is protected by copyright law. The Foundry is the sole, exclusive owner of all intellectual property rights, including rights under copyright and trademark law. Licensee agrees not to use the Font in any manner that infringes the intellectual property rights of The Foundry or violates the terms of this EULA. Licensee will be held legally responsible, for any infringements on The Foundry’s rights caused by failure to abide by the terms of this EULA.
11. Termination
This EULA is effective until terminated. If Licensee fails to comply with any term of this EULA, The Foundry may terminate the EULA with 30 (THIRTY) days notice. This EULA will terminate automatically 30 (THIRTY) days after the issuance of such notice. During the 30-day notice period, Licensee must cease all non-compliant use.
12. Disclaimer and Limitation of Liability
The Font and related documentation are provided “AS IS” and without warranty of any kind. The Foundry expressly disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The Foundry does not warrant that the operation of the Font will be uninterrupted or error-free, or that the Font is without defects.
The Font is not fault-tolerant and is not intended for use in circumstances requiring fail-safe operation, such as manufacturing, navigation, or process control equipment, or where failure could lead to death, personal injury, property damage, or environmental harm.
Under no circumstances shall The Foundry be liable for any direct, indirect, special, consequential, or incidental damages (including lost profits, business interruption, or loss of business information) arising from the use or inability to use the Font, even if advised of such possibility. In no event shall The Foundry’s liability exceed the purchase price of the licence or replacement of the Font, at The Foundry’s discretion.
The Foundry will, at its sole discretion, replace the Font or refund the licensing fee if the Font does not perform substantially as documented, provided the claim is submitted within 30 (THIRTY) days of purchase with a sales receipt.
Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.
13. Governing Law
This EULA is governed by the laws of Ireland. Any disputes arising under this EULA shall be resolved in the courts of Cork, Ireland. This choice of law does not deprive the Licensee of protections under mandatory laws of their jurisdiction.
14. Good Will
A credit to The Foundry would be appreciated by the font designer for use of the font(s), if a credits and attributions section is applicable/allowed in the end product.
