This Digital Ads Licence (or EULA) allows use of the font(s) for the purpose of displaying text for all digital advertising purposes on any website (in any format), for digital billboards, email marketing, social media ads, etc. Please note that this licence allows the font(s) to be used for a SINGLE ADVERTISING CAMPAIGN only. For example, if an advertiser launches Product A with these fonts being used for that campaign and for consistency wishes to use the same fonts to launch Product B some time after, then an additional licence needs to be purchased for Product B. Note that the fonts in this package are in WOFF format, if you require an alternative file format, please contact The Foundry directly.

|---|---|
| Render text with the fonts for a single digital advertising campaign. The licence covers unlimited impressions/views for that campaign. | Any advertising using the fonts that is intended to be screened on Television, at a Cinema, or on any Streaming Platform is prohibited. A Screen & Broadcast EULA is required for that type of advertising. |
By downloading and/or installing font software (“Font”) offered by Paulo Goode (“The Foundry”), you (“Licensee”) agree to be bound by the following terms and conditions of this End User Licensing Agreement (“EULA”):
1. Right Granted
This Digital Ads EULA applies to each individual Font offered by The Foundry whether a single font or multiple fonts were purchased from The Foundry website. Use of the Font is limited to a single advertising campaign – see Section 2 “Usage” for clarification. The Font is provided in WOFF format as the most popular use for this package is to create HTML 5 advertisements. If an alternative file format is required, please contact The Foundry directly.
Once full payment is received, The Foundry grants the Licensee a perpetual, worldwide, non-exclusive, and non-transferable licence to use the Font and advertising designs created with it. This grant is subject to full compliance with all terms of this EULA. The Licensee may create artwork (e.g., rasterised text saved as graphic images in JPG, GIF, PNG, and SVG formats, or motion graphics in MP4, MOV, WEBM, etc. formats) for any form of digital advertising, including uploading the Font to a web server and referencing it via @font-face in CSS for styling live text on websites. This EULA allows for unlimited impressions/views for the duration of the single digital advertising campaign.
The Licensee may make one backup copy of the Font solely for archival purposes.
2. Usage
The Licensee may use the Font for any digital advertising in a single advertising campaign.
A digital advertising campaign can include multiple styles of advertising delivered to multiple platforms. For example, a book publisher has arranged a marketing campaign for an author’s first novel. The campaign includes HTML ads set to appear on numerous websites, some ads are to be displayed on digital screens in bus shelters, some pitchside digital billboards will be utilised in numerous sports arenas, and there’s also a targeted Instagram ad campaign across all variations of its app and website. This Digital Ads EULA allows use of the Font for that entire campaign for the author’s first novel. When the publisher wishes to use the same Font for design consistency in a new campaign for the author’s second novel, then a second Digital Ads EULA must be purchased.
This EULA does not allow the Font to be used in advertising intended for broadcast on television, screening in cinemas, distribution on physical media (e.g., Blu-ray or DVD), or in video content distributed via streaming services (e.g., Netflix, YouTube). A separate Screen & Broadcast EULA is required for such uses.
3. Limitations of Use
Use of the Font, as described below, IS NOT PERMITTED. An alternative EULA or custom licence may be purchased from The Foundry to suit your requirements.
a) Desktop Use. Installing the Font on desktop computers or laptops for offline use is prohibited. The Desktop EULA is required for all such purposes where a desktop-specific font format (OTF) is provided.
b) Electronic Devices. Embedding the Font for use on any electronic device such as gaming consoles, smartphones, e-readers, etc. is prohibited. Alternative EULAs (for App and eBook) are available through The Foundry website, however, in some cases a custom licence may still be required.
c) Software. Embedding the Font for use in any software for distribution and intended monetary gain is prohibited. An alternative EULA (for App) should cover most requirements and is available through The Foundry website, however, in some cases a custom licence may still be required.
d) Websites. Uploading the Font to a website for anything other than an advertising campaign on the Internet is prohibited. The Webfont EULA is required for the purposes of displaying live text on a website to deliver its written content to visitors.
e) Screen & Broadcast. As clarified in Section 2 “Usage”. A Screen & Broadcast EULA is available through The Foundry website to cover advertising in video format on screen and in broadcasting and streaming instances.
f) Graphic Assets. Creating or distributing (for free or for payment) any derivative products based on the Font—including alphabet graphics, SVG/PNG glyphs, logo templates, mockups, website or motion graphics templates, or any asset allowing third-party text input—is prohibited. This also includes bundling the Font in any software or digital product for resale or redistribution. A custom licence is required for such uses.
4. Provision to Third Parties
Licensee may temporarily provide the Font to a graphic designer, web developer, agent or independent contractor who is working on behalf of the Licensee, ONLY IF the designer, developer, agent or independent contractor (1) agrees in writing to use the Font exclusively for Licensee’s work, according to the terms of this EULA, and (2) retains no copies of the Font or reuses the Font upon completion of the work. Licensee may not otherwise distribute the Font to third parties or make the Font publicly accessible except by embedding or linking in accordance with this EULA.
5. Term
This EULA grants a perpetual licence for the rights set forth in Paragraph 1 unless and until the EULA terminates under Paragraph 9. The Foundry will not charge additional fees after purchase, annually or otherwise.
6. Other Usage
If the Licensee is a design consultancy, advertising agency, or purchasing this EULA on behalf of a client or other organisation, the ultimate end user (e.g., the client) must purchase their own separate Digital Ads EULA if they require access to or use of the Font. This EULA covers use by the Licensee’s temporary staff, freelancers, or contractors only for the single licensed campaign and does not extend to their independent professional use.
EULAs for desktop installation, computer applications and games, installable interactive books, software, mobile applications and games, eBooks and ePubs, product creation websites, website template distribution, website templates, and other uses not allowed by this EULA are available at The Foundry website.
7. Modifications
Licensee may not modify the Font or create derivative works based on the Font without prior written consent from The Foundry.
8. Copyright
The Font is protected by copyright law. The Foundry is the sole, exclusive owner of all intellectual property rights, including rights under copyright and trademark law. Licensee agrees not to use the Font in any manner that infringes the intellectual property rights of The Foundry or violates the terms of this EULA. Licensee will be held legally responsible, for any infringements on The Foundry’s rights caused by failure to abide by the terms of this EULA.
9. Termination
This EULA is effective until terminated. If Licensee fails to comply with any term of this EULA, The Foundry may terminate the EULA with 30 (THIRTY) days notice. This EULA will terminate automatically 30 (THIRTY) days after the issuance of such notice. During the 30-day notice period, Licensee must cease all non-compliant use.
10. Disclaimer and Limitation of Liability
The Font and related documentation are provided “AS IS” and without warranty of any kind. The Foundry expressly disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The Foundry does not warrant that the operation of the Font will be uninterrupted or error-free, or that the Font is without defects.
The Font is not fault-tolerant and is not intended for use in circumstances requiring fail-safe operation, such as manufacturing, navigation, or process control equipment, or where failure could lead to death, personal injury, property damage, or environmental harm.
Under no circumstances shall The Foundry be liable for any direct, indirect, special, consequential, or incidental damages (including lost profits, business interruption, or loss of business information) arising from the use or inability to use the Font, even if advised of such possibility. In no event shall The Foundry’s liability exceed the purchase price of the licence or replacement of the Font, at The Foundry’s discretion.
The Foundry will, at its sole discretion, replace the Font or refund the licensing fee if the Font does not perform substantially as documented, provided the claim is submitted within 30 (THIRTY) days of purchase with a sales receipt.
Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.
11. Governing Law
This EULA is governed by the laws of Ireland. Any disputes arising under this EULA shall be resolved in the courts of Cork, Ireland. This choice of law does not deprive the Licensee of protections under mandatory laws of their jurisdiction.
12. Good Will
A credit to The Foundry would be appreciated by the font designer for use of the font(s), if a credits and attributions section is applicable/allowed in the end product.
